Family Things — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Family Things mobile application, website and related services (collectively, the "Service").

Family Things is operated by Anna Krat, a sole trader based in Scotland, United Kingdom, trading as Family Things ("Family Things", "we", "us" or "our").

By creating an account, accessing or using Family Things, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

1. About Family Things

Family Things is a household organisation service designed to help individuals and families organise, record, locate and manage information about their belongings.

The Service may include item records, photographs, storage locations, household organisation, family sharing, search, artificial intelligence ("AI") assisted item recognition and categorisation, and other related features.

2. Eligibility and Accounts

You must provide accurate information when creating and maintaining your account.

You are responsible for keeping your login credentials secure and for activity carried out through your account.

Where Family Things allows multiple people to participate in the same family or household, users may be able to access information shared within that household according to their permissions.

You should only add people to a household or share information with people whom you intend to have access to that information.

You are responsible for ensuring that information you upload or share through Family Things does not violate the rights of another person.

3. The Service

Family Things provides tools to help you organise information about household and personal belongings.

Features may change over time as we improve the Service. We may add, modify or discontinue features where reasonably necessary.

We aim to keep Family Things available and reliable, but we do not guarantee that the Service will always be available without interruption, delay or error.

4. AI-Assisted Features

Family Things may use artificial intelligence and automated systems to assist with features such as:

AI-generated information may sometimes be incomplete, inaccurate or incorrect.

You remain responsible for reviewing information that is important to you before relying on it.

Family Things should not be used as the sole record for information where loss or inaccuracy could create significant financial, legal, health, safety or other serious consequences.

5. User Content

You may upload or create content through the Service, including photographs, item information, descriptions, locations, notes and other household information ("User Content").

You retain ownership of your User Content.

You grant us a limited licence to host, store, process, transmit and display your User Content to the extent reasonably necessary to operate, maintain, secure and provide the Service and its features.

You confirm that you have the necessary rights to upload and use any content you submit to Family Things.

6. Free and Premium Features

Family Things may provide both free and paid features.

The features included in each plan are described within the Service and may change as Family Things develops.

Premium features require an active Premium subscription unless otherwise stated.

Any material changes affecting an existing paid subscription will be handled in accordance with applicable law and the requirements of the relevant app store.

7. Premium Subscriptions

Family Things offers auto-renewable Premium subscriptions, which may include Monthly and Annual plans.

The exact subscription price, billing period, trial or promotional offer and other material subscription terms will be displayed before you confirm your purchase.

Subscriptions purchased through the Apple App Store are billed and managed by Apple.

Subscriptions purchased through Google Play are billed and managed by Google.

Family Things does not directly process payments made through Apple or Google.

Unless cancelled, your subscription automatically renews at the end of each billing period and your app store account will be charged the applicable subscription price.

Prices may vary depending on your country or region, currency, applicable taxes and app store pricing.

8. 14-Day Free Trial

Eligible new subscribers may receive a 14-day promotional free trial of Family Things Premium.

Trial eligibility is determined according to the applicable offer and app store rules and may depend on your previous subscription or trial history.

Before subscribing, you will be shown the applicable trial period, selected subscription plan and the price that will apply after the trial.

Unless you cancel before the free trial ends, your selected subscription will automatically convert to a paid subscription and your Apple App Store or Google Play account will be charged the subscription price shown when you subscribed.

If you select the Monthly plan, the applicable Monthly subscription price will be charged after the trial.

If you select the Annual plan, the applicable Annual subscription price will be charged after the trial.

The subscription will then continue to renew automatically at the applicable billing interval unless cancelled.

You can cancel during the free trial to prevent the subscription from converting to a paid subscription.

Availability of a free trial is not guaranteed and may vary according to eligibility, platform, country, region or promotional availability.

The 14-day promotional free trial is separate from any statutory cancellation, withdrawal or refund rights that may apply to you under consumer law. It does not extend, replace or remove those rights.

9. Managing and Cancelling Your Subscription

You may manage or cancel your subscription at any time using the subscription management functionality made available through the store where you purchased it.

Family Things provides access from within the app to the applicable subscription management service.

For subscriptions purchased through Google Play, you can manage or cancel your subscription through Google Play.

For subscriptions purchased through the Apple App Store, you can manage or cancel your subscription through your Apple account.

Cancellation normally stops future automatic renewal. Subject to the applicable store's rules and applicable law, you will generally continue to have access to Premium until the end of the period for which you have already paid.

Uninstalling Family Things does not cancel your subscription.

Deleting your Family Things account does not necessarily cancel an App Store or Google Play subscription.

If you delete your Family Things account and do not want your subscription to renew, you should also cancel the subscription through the applicable app store.

Cancelling automatic renewal is separate from requesting a refund or exercising any statutory right of withdrawal that may apply to your purchase.

10. Statutory Cancellation and Withdrawal Rights

Depending on where you live and the circumstances of your purchase, you may have statutory rights to cancel or withdraw from a contract for digital services or digital content.

These statutory rights are separate from the 14-day promotional free trial offered by Family Things and from cancelling the automatic renewal of your subscription.

The availability, duration and consequences of any statutory cancellation or withdrawal right depend on applicable consumer law and the circumstances in which the Service began to be supplied.

The existence of a 14-day promotional free trial does not mean that you will automatically receive an additional 14 days of free access after your first subscription payment.

Where your subscription is purchased through the Apple App Store or Google Play, requests relating to payments, refunds or applicable withdrawal rights may be handled through the relevant app store's processes.

Nothing in these Terms limits, excludes or replaces any statutory consumer right of cancellation, withdrawal or refund that applies to you.

11. Refunds

Payments for subscriptions purchased through Apple or Google are processed by the applicable app store.

Requests for refunds for app-store purchases should normally be made using the refund or purchase-support process provided by the store through which you made the purchase.

Refund eligibility depends on applicable law, the circumstances of the purchase and the relevant app store's policies.

Cancelling a subscription does not necessarily entitle you to a refund for an amount already paid.

Similarly, requesting a refund is separate from cancelling automatic renewal. If you do not want your subscription to renew, you should also ensure that the subscription has been cancelled through the applicable app store.

Nothing in these Terms affects any statutory right or remedy available to you under applicable consumer law.

12. Subscription Price Changes

Subscription prices are displayed through the applicable app store before purchase.

Prices may vary by country or region and may include applicable taxes.

If the price of an existing subscription changes, the applicable app store will handle any required notice or consent process in accordance with its policies and applicable law.

You may cancel your subscription if you do not wish to continue at a changed price, subject to the applicable store's terms.

13. Acceptable Use

You must not use Family Things:

We may restrict or suspend access where reasonably necessary to protect users, the Service or others from misuse, fraud, security threats or unlawful activity.

14. Intellectual Property

Family Things, including its software, design, branding, interfaces and materials provided by us, is protected by intellectual property laws.

Except for the limited right to use the Service in accordance with these Terms, no rights in Family Things or our intellectual property are transferred to you.

These Terms do not affect your ownership of your User Content.

15. Data and Backups

We take reasonable measures to maintain the availability, security and integrity of information stored through Family Things.

However, no online service can guarantee permanent or error-free storage.

You should not use Family Things as the only copy of information that is critically important to you.

16. Third-Party Services

Family Things may rely on or integrate with third-party services, including app stores, authentication providers, cloud infrastructure, analytics services and AI technology providers.

Your use of certain third-party services may also be subject to their own terms and privacy policies.

We are not responsible for failures or actions of third-party services outside our reasonable control.

17. Account Deletion

You may stop using Family Things at any time.

You may request deletion of your Family Things account using the account deletion functionality provided within the Service or through the account deletion process described on our website.

Account deletion may result in permanent deletion of information associated with your account, subject to information that we are required or permitted to retain by law.

Deleting your Family Things account does not automatically cancel an Apple App Store or Google Play subscription.

If you have an active subscription, you should manage or cancel it separately through the relevant app store.

18. Suspension and Termination

We may suspend or terminate access to the Service where reasonably necessary because of serious or repeated violations of these Terms, unlawful activity, fraud, security threats or misuse of the Service.

Where reasonably possible and appropriate, we will provide notice before taking such action.

Termination of your Family Things account does not affect rights or obligations that arose before termination.

19. Changes to the Service

We may update Family Things, introduce new functionality or change existing functionality.

We may temporarily suspend parts of the Service for maintenance, security, technical or operational reasons.

Where a change materially affects users' rights or an existing paid subscription, we will provide notice where required by applicable law.

20. Disclaimer

Family Things is intended as a household organisation and information management tool.

Although we take reasonable care in providing the Service, we cannot guarantee that AI suggestions, search results, item records, locations or other information will always be accurate, complete or current.

Nothing in these Terms excludes or restricts any guarantee, warranty, right or remedy that cannot lawfully be excluded or restricted.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when you agreed to these Terms or for losses caused by circumstances outside our reasonable control.

Family Things is intended primarily for personal and household use.

Nothing in these Terms limits your statutory consumer rights.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to Family Things, legal requirements or our business practices.

Where changes materially affect your rights, we will provide reasonable notice where required by applicable law.

The "Last updated" date at the top of this page indicates when these Terms were most recently revised.

24. Governing Law

These Terms are governed by the laws of Scotland, subject to any mandatory consumer protections that apply to you where you live.

If you are a consumer, you may have the right to bring proceedings in the courts applicable to your place of residence.
